State Responses to Allegations of Maltreatment in Out-of-Home Care


A summary of survey data from 24 states and key issues for consideration.

The Child Welfare League of America in partnership with Casey Family Programs conducted a project to develop practice guidelines for the response to and investigation of out-of-home maltreatment in foster homes. 

This 105-page document, published in 2002, summarizes information provided by 24 states concerning their:

  • State legislation and statutory provisions that address the response to and investigation of out-of-home maltreatment
  • State and local policies that provide guidance to the agency in its response to and investigation of out-of-home maltreatment
  • Written protocols and agreements that provide guidance to practitioners regarding their roles and responsibilities in their response to and investigation of out-of-home maltreatment

The findings are based solely on materials received, and, therefore, may not represent a comprehensive portrayal of states’ policies and practices in this area.
